A sanitary inspector has the right to enter your premises at any time of day or night, but a planned inspection is announced in advance. Below: what sanepid requirements a beauty salon must meet in 2026, when an inspection arrives unannounced, how high the fines are, and how to appeal if you disagree with the result<\/p>\n\n\n\n
Salons are supervised by the State Sanitary Inspection under the Act of 14 March 1985 on the State Sanitary Inspection<\/a>. In practice the inspection is conducted by the county sanitary-epidemiological station, and the inspector has broad powers under art. 25 of that act: entry to the premises at any time of day or night, access to documents, and taking samples.<\/p>\n\n\n\n Substantively, the inspection rests on two pillars. The first is art. 16 of the Act of 5 December 2008 on preventing and combating infections<\/a>: anyone performing treatments that break tissue continuity must have implemented procedures protecting against infections. The second is the “GIS hygiene and sanitary recommendations for the beauty industry<\/a>” of August 2026: formally recommendations, not law, but this is what the inspector will assess your procedures against. What exactly to have in products and procedures we describe in a separate piece on disinfection<\/a>; here we focus on the inspection itself.<\/p>\n\n\n\n Sanepid inspects a business under the rules of the Entrepreneurs’ Law of 6 March 2018<\/a>, and it contains several rules almost no guide mentions.<\/p>\n\n\n\n The notice.<\/strong> The authority notifies you in writing of its intent to inspect, and the inspection starts no earlier than 7 and no later than 30 days after delivery (art. 48). So you have at least a week to prepare. If 30 days pass without an inspection, a new notice is required. At your request the inspection may start earlier.<\/p>\n\n\n\n The exceptions.<\/strong> An inspection comes unannounced when justified by a direct threat to life or health or by the need to counteract an offence (art. 48 sec. 11). In beauty-industry practice that above all means an inspection after a client’s complaint.<\/p>\n\n\n\n The inspector’s documents.<\/strong> The inspector shows a service ID and delivers an authorisation stating the scope of the inspection. You have the right to check what the inspection covers: actions beyond the authorisation’s scope are grounds for objections.<\/p>\n\n\n\n The time limit.<\/strong> The total time of all inspections at a micro-enterprise is 6 working days per calendar year, at a small enterprise 18 (art. 55). Note: older guides state 12 days for micro-businesses, but the limit was lowered in the 2025 deregulation.<\/p>\n\n\n\n The objection.<\/strong> If an inspection breaks these rules, for example lasts too long or started without notice outside the exceptions, you can file a written, justified objection within 3 working days (art. 59).<\/p>\n\n\n\n There has been no detailed regulation for salons since 2012, so the inspector assesses the premises against the procedures obligation of art. 16 and the GIS guidelines. In practice the inspection looks at three areas.<\/p>\n\n\n\n Premises and equipment.<\/strong> Access to water, working ventilation, bins and waste containers, a place for clothing. Salon equipment, including work furniture, is assessed from one angle: whether surfaces can be washed and disinfected. A washable counter and upholstery without cracks mean more here than design.<\/p>\n\n\n\n Hygiene and procedures.<\/strong> The procedures sanepid asks about in a beauty studio are at minimum: hand hygiene, surface disinfection after every client, tool handling, and conduct after exposure to blood. A manicure procedure should describe a tool’s route from use through disinfection to sterilisation, or disposal if it is single-use. Products must have a marketing authorisation and labels with contact times.<\/p>\n\n\n\n Documentation.<\/strong> Written procedures with the implementation date, a sterilisation register, a waste-collection contract, safety data sheets for products, confirmations of team training. Usage records help too: when products come off stock in the inventory<\/a> like other materials, you have it in black and white that disinfection actually happens, not just on paper.<\/p>\n\n\n\n Inspectors examine nail stations especially carefully, because this is where contact with blood happens most often: cuticle nippers, the e-file, instrumental pedicure.<\/p>\n\n\n\n Three points decide the outcome. First, reusable tools that break the skin require sterilisation: an autoclave in the salon or a contract with a sterilisation service, with documents for either; the alternative is single-use tools with purchase invoices. Second, dust: an e-file requires an extractor and the station regular cleaning, because settled dust is the first thing an inspector sees. Third, the station itself: a washable counter, a lamp, and a nail stylist’s chair chosen for ergonomics; sanepid does not prescribe specific furniture, what matters is that the upholstery can be disinfected.<\/p>\n\n\n\n An inspection ends with a protocol, to which you may submit objections before signing. From there the scenarios look like this.<\/p>\n\n\n\n The fine.<\/strong> For confirmed hygiene offences the inspector imposes an on-the-spot fine: in summary proceedings it is 100\u2013500 z\u0142 per offence, up to 1000 z\u0142 for several at once (the Code of Procedure in Petty Offence Cases<\/a>, art. 96). You may refuse the fine: the case then goes to court, where the upper limit of a petty-offence fine is 5000 z\u0142.<\/p>\n\n\n\n The administrative decision.<\/strong> For irregularities requiring repair, sanepid issues a decision with a deadline to remove the deficiencies. A decision of the county inspector can be appealed to the voivodeship sanitary inspector within 14 days of delivery.<\/p>\n\n\n\n Suspension of business.<\/strong> In extreme cases, with a direct threat to health, the inspector may suspend the operation of the establishment until the violations are removed.<\/p>\n\n\n\n The inspection charge.<\/strong> A little-known provision: if the inspection finds a violation of hygiene requirements, you bear charges equal to the costs of the inspection activities and tests (art. 36 of the act on the Sanitary Inspection). An inspection with no violations is free of charge. A clean salon literally pays off.<\/p>\n\n\n\n Can you get a sanepid fine for painted nails?<\/strong><\/p>\n\n\n\n There is no provision fining the polish itself: a sanepid fine for painted nails is, in that form, a myth. The inspector can, however, penalise real violations of staff hand hygiene, for example neglected hands while working on a client’s skin. The GIS guidelines speak of well-kept, clean hands, not of polish colour.<\/p>\n\n\n\n A mobile beauty salon and sanepid: what rules apply?<\/strong><\/p>\n\n\n\n The obligations follow the service, not the premises. Performing treatments that break tissue continuity at a client’s home, you are still subject to art. 16 of the infections act: procedures, products with a marketing authorisation, single-use or sterilised tools, safe transport of waste. Having no fixed premises does not exclude a sanepid inspection.<\/p>\n\n\n\n Does sanepid have to approve the premises before a salon opens?<\/strong><\/p>\n\n\n\n No. A sanepid approval of beauty premises is not required today, and the rules do not provide for registering the business with the station either. A sanitary opinion appears when the use of the premises changes, for example from residential to services, but that is a construction-law requirement. A beauty salon must meet sanepid requirements from the first day of work.<\/p>\n\n\n\n Does a sanepid inspection have to be announced?<\/strong><\/p>\n\n\n\n A planned one, yes: a written notice and a start between the 7th and 30th day after delivery, per art. 48 of the Entrepreneurs’ Law. An inspection comes unannounced at a direct threat to health or to counteract an offence, most often after a client’s complaint.
